1. Scope and Provider Information
(1) These General Terms and Conditions (hereinafter referred to as "Terms") apply to all contracts concluded between Luca Heinze (hereinafter referred to as "Seller", "we", or "us") and the customer (hereinafter referred to as "Customer" or "you") via our online store.
(2) A consumer is any natural person who enters into a legal transaction for purposes that predominantly can be attributed neither to their commercial nor their independent professional activity (Section 13 BGB - German Civil Code). An entrepreneur is a natural or legal person or a partnership with legal personality who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction (Section 14 BGB).
2. Contract Formation
(1) The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order (invitatio ad offerendum).
(2) By clicking the button "Buy now", "Complete order", or similar, the Customer submits a binding offer to purchase the goods in the shopping cart.
(3) The Seller will confirm receipt of the order immediately by email. This automated confirmation of receipt does not yet constitute acceptance of the offer. The contract is concluded when the Seller sends a separate order confirmation or dispatches the goods to the Customer.
3. Prices and Payment Terms
(1) All prices quoted in the online store are total prices including applicable statutory value-added tax (VAT), if applicable, plus shipping costs.
(2) Shipping costs are clearly indicated during the checkout process before the order is finalized.
(3) Payment methods offered to the Customer are displayed in the online store. The Customer selects the preferred payment method during checkout.
4. Delivery and Shipping Terms
(1) Delivery is made to the shipping address specified by the Customer during the order process.
(2) Delivery times provided on the product detail pages or during checkout are estimates and begin upon receipt of payment.
(3) If the delivery fails because the Customer provided an incorrect or incomplete address, or fails to accept the delivery, the Customer shall bear the reasonable costs incurred for the returned shipment.
5. Right of Withdrawal (Cancellation Policy)
If you are a consumer residing in the European Union / European Economic Area, you have a statutory right of withdrawal as outlined below:
INSTRUCTIONS ON WITHDRAWAL
Right of Withdrawal:
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Luca Heinze, Weimarische Str. 25, 10715 Berlin, Germany, Email: [Your Support Email Address]) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email).
Effects of Withdrawal:
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
6. Retention of Title
The delivered goods remain the property of the Seller until full payment of the purchase price has been received.
7. Warranty and Statutory Rights
(1) Statutory warranty rights apply according to German law (Sections 434 et seq. BGB).
(2) For consumers, the limitation period for warranty claims for new items is two (2) years from the date of delivery.
8. Limitation of Liability
(1) The Seller is liable without limitation for intent, gross negligence, and for damages resulting from injury to life, body, or health.
(2) In cases of slight negligence, the Seller is only liable for the breach of an essential contractual obligation (cardinal duty), limited to the foreseeable, typical damage occurring under the contract.
9. Online Dispute Resolution and Consumer Dispute Settlement
(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
(2) We are neither obligated nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
10. Applicable Law and Severability
(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG), provided that mandatory consumer protection regulations of the Customer's country of residence remain unaffected.
(2) Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
